Non-Discrimination



Rehabilitation Act of 1973: Section 504 states (in part):

“No otherwise qualified individual with a disability in the United States, as defined in section 705(20) of this title, shall, solely by reason of her or his disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving federal financial assistance …”

 

FHDA Board Policy 4670:

The Board of Trustees upholds that, for persons with disabilities, improving the access to educational employment opportunities must be a priority. The Board of Trustees directs the administration to take the necessary actions to implement the requirement of the Americans with Disabilities Act and Section 504 of the Rehabilitation Act.

The Foothill-De Anza Community College District shall not discriminate against a qualified individual with a disability because of the disability with regard to employment or with regard to the provision of District programs, service and activities.

A person who is otherwise qualified may request accommodation related to his/her disability, provided that the accommodation does not impose an undue hardship on the District. The procedures for requesting an accommodation are maintained in the President's Office and the office of the ADA Coordinator at each campus and in the District Office.

What is My Role as a Faculty Member?

As a faculty member, you are an integral part of your institution's efforts to comply with these laws.  Just as you are not free to discriminate against students on the basis of race, religion, gender or ethnicity, so too, you cannot discriminate against students with disabilities. Part of not discriminating against students with disabilities is the provision of accommodations or "academic adjustments" and  "auxiliary aids and services".  Institutional compliance is a shared responsibility of which faculty are a necessary part.  Your employment in that capacity requires that you assist the institution in fulfilling its compliance responsibilities in connection with the ADA as well as other civil rights statutes.
